Court finds chalking tires for parking enforcement is unconstitutional

Chalking tires ruled unconstitutional

SARASOTA (WWSB) - Park your car anywhere in downtown Sarasota, there’s a good chance your tires will be marked with chalk to gauge how long you’ve been in that space.

The 6th U.S. Court of Appeals has ruled this is unconstitutional. However, the 6th District doesn’t include Florida, so tire chalking will continue here in Sarasota.

Susan Nilon of The Nilon Report says once this decision makes its way through appeals and possibly through the Michigan State Supreme Court, Florida lawmakers may start thinking of where they want to take it.

“Some of our legislators might be in agreement with that law that it is a violation of our constitutional rights and they might say this might be something that I can hook onto then introduce it as a piece of legislation," said Nilon.

City officials are following the case, but at this point not making any changes.
