VENICE, Fla. - Is it a code violation, or is the code violating constitutional rights? A Venice man says the city is infringing on his freedom of religion after they threaten to fine his home for a religious sign in the front yard.
Shane Roessiger says a small group of people come to his Venice home to pray. He was recently given a violation by the city for operating a house of worship. "The same exact people can come on Monday night and watch football or read a book and discuss a book, but I can't have those same people come to my house and share the bible."
That issue with the city has been put on hold.
Thursday, city code inspectors didn't mention the 20 foot cross in his front yard. However, they do have a problem with a small sign referencing a prayer hotline. "It doesn't matter if the sign said come in and pet my puppies. The sign would not be allowed. I am sure you could imagine what the town would look like if everyone decided they wanted to put whatever sign they wanted on the front lawns," says code inspector John Patek.
But there already are signs -- real estate, political, and others -- all around. Those are okay in the city's 30-year-old code. "If there were no signs allowed, then I would not put a sign up. But since everyone who feels like putting a sign up can," says Shane.
