Suit filed against sheriff's office in drunk driving death of jogger

SARASOTA, FL. - The Sarasota County Sheriff's Department is being sued for negligence resulting in the drunk driving death of a female jogger.

The Mallard Law Firm announced the filing of the suit on Thursday. The intent to sue was announced in April of this year.

Deputies say an accused drunk driver, Blake Talman, hit and killed Donna Chen while she was jogging last January.

Chen's family filed the lawsuit. It claims Talman was drunk on the beach when deputies told him to leave. The suit contends that by doing so, the deputies created a risk of injury that resulted in the death of Chen.

The sheriff's office contends its deputies did not have probable cause to arrest Talman.
