SARASOTA COUNTY - A Sarasota man charged with First Degree Murder of a SCAT bus driver in 2011 will not face the death penalty if convicted.

The State Attorney's Office announced in court Wednesday that they would not seek the death penalty against Charles Hill.

Hill is charged in the 2011 murder of James Brotherton. Prosecutors say Hill held up Brotherton at gunpoint and forced him to withdraw money from an ATM before killing him.

Brotherton was a Sarasota County transit driver who was sleeping in his car before a shift when he was reportedly approached by Hill.

The trial is scheduled for October 7th.
