    No it's call legal or not. Reality check smoking is a legal activity for people ages of 18 and older in this country. If you do not like the smoke try not hanging around where people are exorcising their legal right to consume tobacco products in certain areas. The way I see it, tobacco users pay taxes and then some for this right so try removing yourself from the path of smoke. Are we stupid nothing else to say,right?

    I was against smoking bans when I was a smoker. But since I switched to electronic cigarettes two years ago, I don't have to worry about smoking bans, tar, smell or really high cigarette taxes! http://www.savecig.com

    Or maybe they could admit that they aren't God, and let ALL people enjoy themselves.

    I woould lik about to translate a quote in the story the smoking ban in public places in Sarasota from the perspective of a person who suffers from severe asthma and COPD.

    From your story: attorney Andrea Mogensen defended a woman who was arrested for smoking in a city park.

    "We recognize smoking is unpopular to a significant section of the community, but there has to be room for everyone," Mogensen said.

    My translation: "We recognize that second hand smoke is a severe health hazard, even life-threatening to a significant section of the community, but alsthough smokers who go for a short period of time are highly unlikely to end up being hospitalized, their desire to give into their addiction takes precedence over the needs of those afflicted with lung disease. There simply is no room for those who have lung disease in public parks and beaches."

    I told them time and again it was illegal all over the state in these lil towns like gulfport that seethed and laughed as they passed their ban.....they were told and they were shown the law,yet did it anyway!

    Naples tried to get bill 211 passed to remove the states preemeption law on smoking.It was D.O.A. in comittee! yet the smokefree advocates are still pushing it!

    2011 HB 211 Florida Clean Indoor Air Act Died in Health & Human Services Quality Subcommittee

    Current state law:

    This legislation expressly preempts regulation of smoking to the state and supersedes any municipal or county ordinance on the subject".:

    Sarasota and other communities are in clear violation of state law!
