SARASOTA COUNTY - The Venice man convicted of murdering his ex-girlfriend and a neighbor is asking a judge for a mistrial.

John Allen Lee was convicted in March of the double murders of Traci Nabergall and Jason Salter. He was scheduled to be sentenced Tuesday, but that has been delayed after his attorney filed a motion last week asking for a mistrial.

According to the court documents, Lee's attorney is claiming "misconduct" on the part of the State Attorney's Office.

The motion goes on to say that Lee did not receive a fair and impartial trail. If granted, this would be the second mistrial for Lee.
