MANATEE COUNTY-- A family who has been waiting two and half decades for justice is one step closer.

This week, a Federal appeals court denied Daniel Burns Jr his latest request. It is the last and final request he can make to appeal his conviction relating to the death of FHP Trooper Jeff Young in 1987.

Young, a Manatee County native, was shot and killed by Burns during a routine traffic stop along I-75 in Manatee County. Now 68-years-old, Burns has been on death row for the last 25 years. It's inexcusable says Young's two brothers.

"To condemn someone to death and put them in prison for 25 years to live off the money of the people of Florida is ridiculous," said Dave Smith, Young's brother.

"Justice delayed is justice denied," said Young's other brother, Wayne Young.

Burns has an option now to ask the United States Supreme Court to review the case. However, such requests are usually not granted. Several years ago, he tried and was denied.

"The clock is running down. We are finally making serious headway and getting close to reaching the conclusion to this whole thing," said Wayne.

According to Smith, the execution could come by the end of 2013.
