SARASOTA, Fla. - A 5-month-old girl has been located safely by authorities after the Florida Department of Law Enforcement issued an Amber Alert early Thursday morning.
However no charges are expected to be filed against the man who had the child.
According to the Sarasota Police Department, around 1am Thursday, Lucio Martinez-Lopez told police that his wife Teresa Martinez-Lujano had been transported to the hospital with a medical emergency where she later passed away from natural causes.
Lucio told police that Teresa and their 5-month-old daughter Brianna checked into the Cadillac Motel on North Tamiami Trail, just before Teresa was transported to the hospital. Teresa's reported boyfriend, Aldequndo Benitez-Caivillo, was with Teresa before she was transported to the hospital and took possession of the child until he could alert the proper authorities.
Lucio told officers he was concerned the child would be taken away from Florida, and that Aldequndo and the child were last seen at the motel at approximately 10:45 p.m. Wednesday.
After a search for Aldequndo at two known addresses came up empty, an Amber Alert was issued by the FDLE around 7am.
A family member of Alequndo then contacted the Manatee County Sheriff's office, who then located Alequndo and Brianna in the 1400 block of 24th Street East in Palmetto.
The Amber Alert was cancelled for Brianna Martinez-Lujano and Aldequndo Benitez-Caivillos just after 9am.
Sarasota Police say at this time, it is unlikely that criminal charges will be filed, because the Sarasota Police Department does not have probable cause that there was intent to commit a crime.
