HOLMES BEACH, FL (WWSB) - A Holmes Beach couple still isn't ready to give up the fight to save their backyard tree house.
Lynn Tran and Richard Hazen have been in a legal battle with the City of Holmes Beach for years over an elaborate tree house behind their property on Anna Maria Island.
The couple has taken the dispute to each level of the Floria court system and even submitted their case to the Supreme Cout, which denied to hear the case.
After the supreme court refused to hear the case last week, the couple has decided to give the city another a chance.
Tran and Hazen tell ABC 7 that they plan to make some structural changes to the tree house and reapply for a permit. Something that the city has denied them in the past.
Both the couple and the city have spent more than $100,000 fighting the case.
